In a farming divorce the courts have to ascertain the value of the farm and associated business and will endeavour to ensure fairness for both parties. It is unusual for a court to order the sale of an entire farm. More frequently, consideration will be given to the possibility of selling parts of the farm or hiving off parts of the business so as to pay out the departing spouse.
Farms that have been inherited are often treated slightly differently and we can provide specialised advice on that.
